Before registering as a user, please carefully read these Terms of Service (hereinafter referred to as the "Terms") to ensure you fully understand each provision herein. Please read the Terms carefully and choose to accept or decline them. You shall not be entitled to register, log in, or use the services covered by these Terms unless you accept all provisions of the Terms. Your acts of registration, login, and use of the services shall be deemed acceptance of these Terms, and you agree to be bound by each provision hereof.
These Terms set forth the rights and obligations between Shenzhen Miaosuan Technology Co., Ltd. (hereinafter referred to as "AI Expert") and users with respect to the software services of "AI Expert" (hereinafter referred to as the "Services"). A "User" means an individual or organization that registers for, logs in to, or uses the Services.
We may update these Terms at any time. Once updated, the new Terms shall immediately replace the original ones, and no further individual notice will be sent. Users may access the latest version of the Terms within this Application. After the Terms are revised, if you do not accept the revised Terms, please immediately cease using the Services we provide. Your continued use of the Services will be deemed acceptance of the revised Terms.
I. Account Registration
1. To use the Services, you are required to register an account for this Application. Account registration must be bound to an email address. You shall use an email address that is neither already bound to any existing account of this Application nor blocked under our Terms to complete the registration. We may modify the methods for account registration and binding based on user needs or product requirements, without prior notice to you.
2. Given the email-binding requirement for account registration as specified above, you agree to allow your email information to be used for registering an account of this Application.
3. During your account registration and use of the Services, we need to collect personal information that can identify your identity. Such collection is necessary to enable us to contact you when required or to provide you with a better user experience. The information we collect includes but is not limited to your name and address. We agree that the use of such information shall be subject to the constraints set forth in Section III: Protection of Users’ Personal Privacy Information.
II. Protection of Users' Personal Privacy Information
1. If we discover, or receive reports or complaints from third parties indicating that a User has violated the provisions of these Terms, we shall have the right to review and delete relevant content (including but not limited to User information and post records) at any time without prior notice. Depending on the severity of the violation, we may also impose penalties on the non-compliant account, including but not limited to warnings, account bans, device bans, and function bans, and notify the User of the handling result.
2. Users whose accounts have been banned due to violating these Terms may contact us on their own initiative. Among them, Users subject to function bans will have the banned functions automatically restored upon the expiration of the ban period. Banned Users may submit an appeal; we will review the appeal and make a reasonable independent judgment to decide whether to modify the penalty measures.
3. Users understand and agree that we shall have the right to impose penalties on acts that violate relevant laws, regulations, or the provisions of these Terms based on reasonable judgment, take appropriate legal actions against any User who violates laws or regulations, and retain relevant information to report to the competent authorities in accordance with laws and regulations. Users shall bear all legal liabilities arising therefrom.
4. Users understand and agree that if a User’s violation of the provisions of these Terms leads to or gives rise to any claims, demands, or losses (including reasonable attorney fees) asserted by any third party, the User shall compensate us, our cooperative companies, and affiliated companies, and hold them harmless from such claims, demands, or losses.
III. Specifications for User-Generated Content
1. The "Content" mentioned in this Article refers to any content created, uploaded, copied, posted, or disseminated by Users in the course of using this Application. This includes, but is not limited to: registration information and verification materials such as account avatars, usernames, and user profiles; messages (including sent messages, replies, and auto-replies) and relevant linked pages in the form of text, voice, images, videos, or graphics; and other content generated through the use of the account or the Services.
2. Users shall not use their accounts for this Application or the Services to create, upload, copy, post, or disseminate any content prohibited by laws, regulations, or policies, including but not limited to content that:
(1) Opposes the fundamental principles established by the Constitution;
(2) Endangers national security, discloses state secrets, subverts state power, or undermines national unity;
(3) Impairs national honor or interests;
(4) Incites ethnic hatred or discrimination, or undermines ethnic unity;
(5) Violates state religious policies, or propagates cults or feudal superstitions;
(6) Spreads rumors, disturbs social order, or undermines social stability;
(7) Disseminates obscenity, pornography, gambling, violence, murder, terrorism, or incites crime;
(8) Insults or defames others, or infringes upon others’ legitimate rights and interests;
(9) Contains other content prohibited by laws or administrative regulations.
3. Users shall not use their accounts for this Application or the Services to create, upload, copy, post, or disseminate any content that disrupts the normal operation of this Application or infringes upon the legitimate rights and interests of other Users or third parties, including but not limited to content that:
(1) Contains any sexual content or sexual innuendo;
(2) Contains abusive, threatening, or intimidating content;
(3) Contains harassing content, spam advertisements, malicious information, or deceptive information;
(4) Involves others’ privacy, personal information, or data;
(5) Infringes upon others’ legitimate rights such as reputation rights, portrait rights, intellectual property rights, or trade secrets;
(6) Contains other information that disrupts the normal operation of the Services or infringes upon the legitimate rights and interests of other Users or third parties.
IV. Usage Rules
1. Any content transmitted or posted by Users in or through the Services does not reflect or represent, nor shall it be deemed to reflect or represent, our views, positions, or policies. We shall not bear any liability whatsoever in this regard.
2. Users shall not use their accounts for this Application or the Services to engage in the following acts:
(1) Submitting or posting false information, or misappropriating others’ avatars or materials to impersonate or use others’ identities;
(2) Forcing or inducing other Users to follow accounts, click on linked pages, or share information;
(3) Fabricating facts or concealing the truth to mislead or deceive others;
(4) Using technical means to create fake accounts in batches;
(5) Using accounts for this Application or the Services to engage in any illegal or criminal activities;
(6) Creating or posting methods or tools related to the acts mentioned above, or operating or disseminating such methods or tools, regardless of whether these acts are for commercial purposes;
(7) Other acts that violate laws and regulations, infringe upon the legitimate rights and interests of other Users, disrupt the normal operation of this Application, or exceed the express authorization granted by us.
3. Users shall bear full responsibility for the authenticity, legality, harmlessness, accuracy, and validity of the information transmitted using their accounts for this Application or the Services. Any legal liability related to the information disseminated by Users shall be borne solely by the Users, and we shall not be held liable therefor. If such information causes damage to us or third parties, the User shall compensate for such damage in accordance with the law.
V. Miscellaneous
1. We solemnly remind Users to pay attention to the clauses in these Terms that exempt us from liability and limit Users’ rights. Users shall read these clauses carefully and independently assess the risks involved. Minors shall read these Terms accompanied by their legal guardians.
2. The validity, interpretation of these Terms, and the resolution of disputes hereunder shall be governed by the laws of the People’s Republic of China. In the event of any dispute or controversy between a User and us, the parties shall first attempt to resolve it through friendly negotiation. If negotiation fails, the User agrees to submit the dispute or controversy to the people’s court with jurisdiction over our place of domicile for adjudication.
3. If any clause of these Terms is deemed invalid or unenforceable for any reason whatsoever, the remaining clauses shall remain valid and binding on both parties.
